Terms of Service

Welcome to CodinGame for Work! CodinGame for Work is CodinGame’s online platform dedicated to companies wanting to source, screen and retain the best developers from all over the world.
“CodinGame” (or “Us” or “Our”), means CodinGame, a limited company with a capital of €53,545. CodinGame’s head office is located at 396 rue du Mas de Verchant, Immeuble Archimède, 34 000 Montpellier, France, registered in the Montpellier trade and company register (RCS) under number B 750 538 613.
“Account” means the account associated with a User once they register on the Site.
“Platform” means any hardware, network and software infrastructure implemented and operated by CodinGame or its subcontractors for the provision of the Services.
“Site” means the website https://www.codingame.com/work/ referred to as the “CodinGame for Work” website.
“Services” means all the Services offered to the User having an Account on the Site.
“Test” means a set of questions, MCQs and programming exercises proposed online by Us with the aim to evaluate the skills of an individual. Tests are available in the context of the “CodinGame Assessment” Service.
“Terms” means this document.
“User” (or “You”, “Your”, “Yourself”) means any entity or person using the Site.
These Terms of Service define the legal agreement made and entered into by and between Us and You regarding the use of the Site and the use of the Services.
The Site is created and administered by CodinGame. The Services are provided by CodinGame.
Any use of the Site or the Services by You means that You agree to these Terms.
3. Use without an Account
4. CodinGame for Work Account
4.1 Account creation
You must register, i.e. create an account on the Site, in order for You to use the Services.
Only persons acting on behalf of a legal entity may register for an Account. In that case “You” means You, the natural person, as well as the legal entity you represent.
By creating an Account, You bind the entity you represent to these Terms.
Each Account must correspond to a unique User aimed at using the Services (free or paying plan) by logging in to the Site with a personal username and password.
Our registration process will ask You for certain information including Your email address, Your legal full name, and the name of Your company. You must provide accurate, valid and complete information about Yourself as well as about the business You represent.
You must also keep the information that You provide up to date. You are responsible for the confidentiality of Your Account information and any activity happening within Your Account. This means that You are entirely responsible for all content that You transmit or otherwise make available while using our Services, and for the consequences of Your actions (including any loss or damage which we may suffer) by doing so.
The Services are only open to legal businesses. The Services are not open to individuals acting on their own, in particular individuals who would like to recruit or evaluate candidates for their own needs or pass Tests for their own use.
You cannot create an Account on behalf of a company if you are not authorized by that company to bind CodinGame and that company by these Terms.
The Services are not open to individuals wishing to create an account with the purpose of training on passing real Tests on the platform. For example using the Services with the objective of cheating, i.e. taking a Test of one our paying plans on the platform with the objective to train for a similar Test to which the individual was invited as a candidate by another customer is strictly forbidden and will be subject to sanctions as stated in §9.
4.3 Termination of an Account
If You have created an Account and You no longer wish to use the Services or you no longer accept these Terms, you may request the termination of your Account by sending an email to firstname.lastname@example.org.
Terminating the Account implies the destruction or anonymization of all data associated with the Account.
5. User obligations
Any User undertakes to act on the Site in a legitimate and legal manner and must be of age by virtue of the law applicable in his or her country of residence.
You hereby agree to abide by these Terms and to act in such a way as not to misuse the Site, interfere with the Platform or abuse any intellectual property rights of any content provided by Us or any other User of the Site.
You agree not to attempt to decipher, decompile, disassemble or reverse engineer any software part of the Site or the Platform.
The use of bots or other methods of automation of the Services is not permitted. The exception to this rule being the use of any offical API provided by Us in the context of a given Service.
6. Available Services
The following Services are available on the Site:
6.1 CodinGame Assessment
CodinGame Assessment is a Service offering Tests that allow you to automatically evaluate the technical skills of candidates You have identified.
The use of this Service, and in particular the creation of an Account associated with the subscription or purchase of a free or paid CodinGame Assessment offer, is subject to the specific CodinGame Assessment Customer Agreement available at https://www.codingame.com/work/codingame-assessment-customer-agreement/. In case of any contradiction between these Terms and the specific Customer Agreement, the specific Customer Agreement prevails.
6.2 Organization of Hackathons
CodinGame can organize for You game-based programming competitions whose terms (private, public, etc.), audience (students, CodinGame community, etc.) and purposes (team building, recruitment, etc.) are defined with You.
The purchase of such a Service must be subject to a specific contract between You and Us (You can contact email@example.com to initiate such a contract). In the event of any conflict between these Terms and the specific contract, the terms of the contract shall prevail.
6.3 CodinGame Sourcing
CodinGame Sourcing is a service that connects you with developers from the CodinGame community.
The use of this Service, and in particular the creation of an Account associated with the subscription or purchase of a free or paid CodinGame Sourcing offer, is subject to the specific CodinGame Sourcing Customer Agreement available at https://www.codingame.com/work/codingame-sourcing-customer-agreement/. In case of any contradiction between these Terms and the specific Customer Agreement, the specific Customer Agreement prevails.
7. Intellectual property and content ownership
The Site, the information contained in the Site and in particular the content of the Tests (questions, programming exercises, etc.) are protected by intellectual property law (in particular copyright, rights related to copyright, trademark law, design rights).
The User undertakes to use the Site, the Platform, the Tests and any content in compliance with property rights. Thus, the User undertakes not to copy, transfer, modify, adapt, translate, sell, sub-license, distribute, copy, download, reproduce or use by any means other than in connection with access to the Services, any content of the Site, which is owned by CodinGame.
The blog (codingame.com/work/blog) is considered an integral part of the Site. As such, unless otherwise stated on the blog, the blog and its content are the exclusive property of CodinGame. However, CodinGame is not responsible for the content of articles posted on the blog when not posted by Us.
Users acknowledge that sharing the content of the Site is not permitted, including sharing the content of the Tests, questions or visuals from the Tests, content and visuals from the hackathons.
The use of the content of the Site on any other website or networked computer environment for any purpose is prohibited, in particular for the purpose of creating referencing and traffic.
Any violation of CodinGame’s intellectual property rights would engage the responsibility of the User who may be prosecuted.
8. Limitation of liability and warranty
CodinGame’s liability is limited to making the Site and Platform available, unless otherwise stated in specific contracts, according to these Terms:
- You acknowledge that the Services and the Site are made available “as they are”. CodinGame does not offer any guarantee as to the adequacy of the Services with Your needs
- CodinGame makes no warranty as to the accuracy, reliability or completeness of the results of Tests or programming competitions conducted on the Site
- CodinGame does not guarantee the absence of defects on the Site and does not guarantee the correction of defects found on the Site
- You acknowledge that We are not liable for any consequential damages of any kind whatsoever resulting from the use of the Site (including loss of profits, business or damage resulting from loss of data or business interruption) due in particular to the use or inability to use the Services of the Site
- CodinGame does not guarantee that the Services are available from any place and at any time
- CodinGame cannot be held liable in the event of an error or malfunction of the Site or Platform
- You are responsible for the content you create on the Site when using the Services, including the creation of customized questions as part of the CodinGame Assessment Service. As such (i) CodinGame shall not be held liable for any viruses distributed by the content you create (ii) You undertake to compensate CodinGame for any expenses incurred by a third party in connection with the content you have created, in particular for reasons of infringement of the third party’s intellectual property rights
- The Site does not offer any guarantee as to the uninterrupted operation and/or continuity of the Services in the event of force majeure or fortuitous events as defined by the regulations in force. Are considered as force majeure exceptional bad weather, natural disasters, fires and floods, lightning, attacks, breakdowns and blockages of telecommunication networks, damage caused by viruses for which the security means available on the market do not allow their eradication, as well as any legal or regulatory obligation or public policy imposed by the competent authorities and which would have the effect of substantially modifying these GCU, or any other event of force majeure or fortuitous event within the meaning of the case law of the French “Court of Cassation”
YOUR SOLE AND EXCLUSIVE RIGHT AND REMEDY IN CASE OF DISSATISFACTION WITH THE SERVICES, THE SITE, OR ANY OTHER GRIEVANCE, SHALL BE YOUR TERMINATION AND DISCONTINUATION OF ACCESS TO THE SITE OR USE OF THE SERVICES.
We reserve the right to terminate or suspend the Account of any User who does not comply with these Terms.
In particular, in the event of suspicion of the creation of an Account by an individual, and/or creation of an Account with the objective of cheating, CodinGame first suspends the Account, then contacts the creator of the Account so that he or she can prove that he or she is acting on behalf of a legitimate business by any means necessary. If the creator is unable to prove that he or she is acting on behalf of a legitimate business, his or her account will be terminated.
Entering incorrect information when creating an account (invalid email address, invalid User name, invalid company name) is another common reason for terminating an Account.
The termination of an Account for non-compliance with these Terms does not entitle You to a refund in the event of a purchase of one of the offers available on the Site.
CodinGame and the User each undertake to maintain in force an insurance contract for themselves and their employees with an insurance company known to be solvent to cover any financial consequences of civil, professional, tortious and contractual liability for damage, in particular material and immaterial damage caused to CodinGame or to the User or to any third party in the context of these Terms.
In addition, CodinGame undertakes to take out appropriate insurance for a minimum amount equivalent to the value of the equipment necessary for the delivery of the Services and to maintain this insurance in force throughout the use of any of the Services by the User.
12. Applicable law
These Terms are exclusively governed by French law. Any disagreement or dispute that is not settled amicably will be submitted exclusively to the competent courts of Montpellier, France.
13. Modification of these Terms
The applicable Terms are those in effect at the time of connection and use of the Site by You. However, CodinGame may freely update the Terms at any time in order to adapt them to changes in the Services and/or their operation.
These modifications are brought to the attention of Users by simply putting them online. They are deemed to have been accepted without reservation by any User who accesses the Site after the said posting. We therefore invite Users to consult this document regularly.
Any new Service incorporating new features that improve the quality of the existing Services will also be subject to these Terms, unless otherwise expressly stated.
